Nobody wants to have their house go into foreclosure. There are financial, social, and emotional issues that all scream “NO!” when homeowners start thinking about foreclosure. Nobody takes the losing of their home lightly, and they wouldn’t be considering it if things weren’t as bad as they could be. However, there may be a way to get out from under the crushing debt, avoid further damage to credit and improve the chances of buying the next home instead of going into foreclosure. How? It’s called a short sale. 


First of all, a short sale is when the house is sold for less than what is owed the bank. The remaining balance will usually still be owed to the bank, but in some cases, that may also be canceled or removed. 

Why is this good? Banks can avoid the hefty fees that they incur during the foreclosure process or money lost during continuing non-payment by the borrower. Borrowers can stop damaging their credit because of non-payment of monthly mortgage payments and find themselves a new home that is more in-line with their current economic situation.

If a property goes into foreclosure, that is a big black mark on a credit history, one that can stay around and haunt someone for 10 years or more. Short sales avoid this because the short sale is often not shown on the credit report. There may be a notation about the payment, but it is not as damaging as “foreclosure” is on a credit report.

This means that a person will be able to get a home loan much sooner. All loan applications will ask if the borrower has had a foreclosure in the past 7 years. If the answer is yes, it is unlikely they will get the loan. Short sales, on the other hand, can shorten the time to be eligible for the next loan by almost half. Borrowers need to remember that every situation is different and the should speak with real estate and banking professionals before jumping into a short sale.

Which brings up the next benefit of a short sale as opposed to a foreclosure; buying the next home. If a borrower falls behind on their payments and their property goes into foreclosure, once all is said and done, it will be 5 to 7 years before they can get a Fannie Mae loan to buy their next home. That’s a long time. If payments are not overdue more than 30 days and the lender is not requiring the borrower to repay the remaining balance of the loan, it is possible to qualify for a new Fannie Mae loan immediately. There’s no guarantee that the borrower will, but Fannie Mae guidelines do not forbid it. Additionally, they only have to wait 3 years for an FHA (Federal Housing Administration) loan. 

Short sales are not the answer to every situation. Some people will not qualify for them; some banks will not allow them. And perhaps nobody will buy the property in the end. However, instead of accepting the inevitable foreclosure, it might be a good idea to check into the possibility.
